Insurance Company of the Americas

Effective January 24, 2018, Insurance Company of the Americas (“ICA”) was ordered into receivership for the purposes of liquidation by the Second Judicial Circuit Court in Leon County, Florida.

With the entry of the liquidation order, the Florida Workers’ Compensation Insurance Guaranty Association (“FWCIGA”) has been activated to help pay outstanding claims for workers’ compensation policies. The processing and payment of covered claims will be made by FWCIGA. There is no cap on claims for workers’ compensation benefits. Claims made under the employers’ liability portion of the workers’ compensation policy are limited to the lesser of policy limits or $300,000. For more information see the FAQ section of this website or the Florida Receiver. No employers liability claim will be paid in excess of this cap.

Claimants who need to check on the status of an existing claim should submit inquiries to the Florida Receiver at Consumer.Services@myfloridacfo.com or by calling (850) 413-3081 or toll free at 1-800-882-3054.  New Claims should be sent to Rehab.ClaimsServices@myfloridacfo.com.

Guarantee Insurance Company

Effective November 27, 2017, Guarantee Insurance Company (“GIC”) was ordered into receivership for the purposes of liquidation by the Second Judicial Circuit Court in Leon County, Florida.

Premium Refunds/Unearned Premium:

FWCIGA will pay certain unearned premium claims, in accordance with Florida Statutes, after the Florida Receiver completes its processing of the policy records and sends the unearned premium records to FWCIGA.

CastlePoint National Insurance Company

CastlePoint National Insurance CompanyEffective April 1, 2017, CastlePoint National Insurance Company (“CNIC”) was ordered into receivership for the purposes of liquidation by the Superior Court of the State of California, City and County of San Francisco.

 With the entry of the liquidation order, the Florida Workers’ Compensation Insurance Guaranty Association (“FWCIGA”) has been activated to help pay outstanding claims for workers’ compensation policies.  The processing and payment of covered claims will be made by FWCIGA.  There is no cap on claims for workers’ compensation benefits.  Claims made under the employers’ liability portion of the workers’ compensation policy are limited to the lesser of policy limits or $300,000.  For more information see the FAQ section of this website or the California Conservation & Liquidation Office website. No claim will be paid in excess of this cap.

Ten weeks of Workers Compensation indemnity (only) claim benefits are being prepaid by the California liquidator to allow for a smooth transition to FWCIGA.  These payments will be disbursed in two separate installments.

Effective May 23, 2016, Lumbermens Underwriting Alliance (“LUA”) was ordered into receivership for the purposes of liquidation by the Circuit Court of Cole County, Missouri.  Bruce Baty of Dentons U.S. LLP was appointed Special Deputy Receiver of LUA.
